Zinier Inc. and its affiliated companies and subsidiaries (collectively referred to as “Company,” “we,” or “us”) respect your privacy. This Privacy Policy Statement describes the ways we collect information from and about you, and what we do with the information, so that you may decide whether or not to provide information to us.
By accessing our website, purchasing our products or services, and/or using our products and services you agree to this Privacy Statement in addition to any other related agreements. This Privacy Statement does not govern the practices of entities that our Company does not own or control, or entities that do not own or control our company or people that our Company does not employ or manage.
Privacy Policy Statement
1. Collection of your personal information
The information we collect from you may include personal information, such as your name, contact information, IP addresses, geolocation, product and service selections and other things that identify you or your business. We collect personal information from you at several different points, including but not limited to the following:
a. In the case we correspond with you as a customer or prospective customer;
b. In the case you visit our website;
c. In the case you register as an end-user of our services and an account is created for you;
d. In the case you contact us for support;
e. In the case you attend our customer conferences, webinars and trainings; and/or
f. In the case the site sends us error reports or application analytics data.
2. Data Controller and Data Processor
We process two main types of personal data.
- Customer Data - Personal data that forms part of data that is provided by our customers and their end-users for processing.
- Other Data - Personal data about our customers, visitors and other individuals that is collected and processed directly by us.
Our Customers are the controller of their Data. Zinier is the processor of all Customer Data serviced through the use of Zinier’s Cloud Platform.
3. Use of your personal information
We may use information that we collect from you and about you for the following purposes. How we use your personal data will depend on which Services you use and how you use those Services.
Customer Data will be used by Zinier in accordance with Customer’s instructions, including any applicable terms in the Customer Agreement and as required by applicable law.
Other Data is used by us to provide our services, send our newsletters and to communicate with you by responding to your requests, comments and questions.:
a. To deliver the products and services that you have requested;
b. To manage your customer relationship and provide you with customer support;
c. To perform research and analysis about your use of, or interest in, our products, services, or content, or products, services or content offered by others;
d. To communicate with you by e-mail, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us, or other third parties;
e. To develop and display content and advertising tailored to your interests on our site and other websites;
f. To verify your eligibility and deliver prizes in connection with promotions, contests and sweepstakes;
g. To enforce our terms and conditions;
h. To manage our business;
i. To perform functions as otherwise described to you at the time of collection; and
j. To provide law enforcement upon request of any data that may be related to ongoing investigations.
4. Lawful bases for processing
We have a lawful basis to process your personal data. We also use your consent as the basis for lawfully processing your personal data.
We process your personal data only when we have a lawful basis. Presently, we use the Performance of Contract (i.e. to deliver the services to our customers) and consent as the lawful basis for processing. For certain processing, we may also use legitimate interests as provided under the Data Protection Regulations.
In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.
Where you have consented to a particular processing, you have a right to withdraw the consent at any time. The Company adheres to Obtaining Valid Consent Procedure as a part of its Data Protection Framework Implemented.
5. Security measures to protect your personal information
Our Company uses industry-standard technologies when transferring and receiving data exchanged between our Company and other companies to help ensure its security. This site has security measures in place to help protect information under our control from the risk of accidental or unlawful destruction or accidental loss, alteration or unauthorized disclosure or access.
We maintain reasonable and appropriate security measures to protect Customer Data from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.
Examples of security measures include physical access controls, HTTPS, restricted access to data, monitoring for threats and vulnerabilities etc.

Protection of personal information:
Our Sites and Services uses commercial efforts to maintain safeguards for protection of your Personal Information
Zinier takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
However, complete and absolute security does not exist on the Internet and Zinier is not responsible for any breach. Also, if this website contains links to other sites, our Company is not responsible for the security practices or the content of such sites.
6. Disclosure of your personal information to third parties
The Company may share your personal information with third parties only in the ways that are described in this Privacy Statement:
a. We may provide your information to our agents, vendors or service providers who perform functions on our behalf;
b. To third party contractors that may have access to our databases. Usually these contractors sign a standard confidentiality and non-disclosure agreement;
c. We may share your data with any parent company, subsidiaries, joint ventures, other entities under a common control or third-party acquirers. We expect these other entities will honor this Privacy Statement;
d. We may allow a potential acquirer or merger partner to review our databases, although we would restrict their use and disclosure of this data during the diligence phase;
e. If required by law enforcement, government officials, or other third parties pursuant to a subpoena, court order, or other legal process or requirement applicable to our Company; or when we believe, in our sole discretion, that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our agreements or Company policies; and
f. To other third parties with your consent or direction to do so.
Please note that these third parties may be in other countries where the laws on processing personal information may be less stringent than in your country.
7. Use of cookies, web beacons and links
a. Our web page use “cookies.” Cookies are text files we place in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information unless you choose to provide this information to us by, for example, registering at one of our sites. However, once you choose to furnish the site with personal information, this information may be linked to the data stored in the cookie. We use cookies to understand site usage and to improve the content and offerings on our sites. We also may use cookies to offer you products, programs, or services. b. Web Beacons. Our Company and third parties may also use small pieces of code called “web beacons” or “clear gifs” to collect anonymous and aggregate advertising metrics, such as counting page views, promotion views, or advertising responses. These “web beacons” may be used to deliver cookies that conform to our Company’s cookie requirements.
c. We may create links to other web sites. We will make a reasonable effort to link only to sites that meet similar standards for maintaining each individual’s right to privacy. However, many other sites that are not associated with or authorized by our Company may have links leading to our site. Our Company cannot control these links and we are not responsible for any content appearing on these sites. Since this website does not control the privacy policies of third parties, you are subject to the privacy practices of that third party. We encourage you to ask questions before you disclose any personal information to others.
d. The Company websites may use third parties to present or serve the advertisements that you may see at its web pages and to conduct research about the advertisements and web usage. This Privacy Statement does not cover any use of information that such third parties may have collected from you or the methods used by the third parties to collect that information.
8. International transfers of your personal information
Information collected from you may be stored and processed in any of our entities locations or any other country in which our Company or agents or contractors maintain facilities, and by accessing our sites and using our services, you consent to any such transfer of information outside of your country.
Since we are an international company, your data maybe be processed outside of the EU region. Your data will be processed within Third Party Data Centers in USA and in UK. Some countries where we process data may not have as protective laws as your own country and there are risks associated with such transfer.
Zinier offers European Union Model Clauses, also known as Standard Contractual Clauses, to meet the adequacy and security requirements for our Customers that operate in the European Union, and other international transfers of Customer Data. These clauses are contractual commitments between parties transferring personal data (for example, between Zinier and its Clients, suppliers or data processors outside the EU), binding them to protect the privacy and security of the data.
9. Your Rights
You can request to access, update or correct your personal information. You also have the right to object to direct marketing.
You may have additional rights pursuant to your local law applicable to the processing. For example, if the processing of your personal information is subject to the EU General Data Protection Regulation ("GDPR"), and your personal information is processed based on legitimate interests, you have the right to object to the processing on grounds relating to your specific situation. Under GDPR you may also have the right to request to have your personal information deleted or restricted and ask for portability of your personal information.
Your Rights to Control Data
Whenever you use our services, we aim to provide you easy means to access, modify, delete, object to or restrict use of your personal information
We strive to give you ways to access, update/modify your data quickly or to delete it unless we have to keep that information for legal purposes. Some rights can be access from within the CLIENTNAME application. For visitors, these rights can be exercised by contacting us with your specific request.
- Change or Correct Data: You can edit some of your personal data through your account. You can also ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.
- Delete Data: You can ask us to erase or delete all or some of your personal data (e.g. if it is no longer necessary to provide Services to you).
- Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data (e.g. if we have no legal right to keep using it) or to limit our use of it (e.g. if your personal data is inaccurate or unlawfully held).
- Right to Access and/or Take Your Data: You can ask us for a copy of your personal data and can ask for a copy of personal data you provided in machine readable form.
Account Closure
We keep some personal data even after account closure
Once you choose to close your account, we generally delete your personal information within 90 days of closure of your account. Some information that is necessary for statutory obligations such as records of transactions, payment processing, invoicing data etc. will be retained as necessary.
10. Retention of your personal information
We will retain any personal information only for as long as is necessary to fulfill the business purpose it was collected for. We will also retain and use your personal information for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
11. Children’s privacy
Because of the nature of our business, our services are not designed to appeal to minors. We do not knowingly attempt to solicit or receive any information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us immediately.
12. Your California privacy rights (ONLY FOR USA)
If you are a California resident, California Civil Code Section 1798.83 permits you to request certain information regarding our disclosure of personal information to third parties for the third parties’ direct marketing purposes. Singapore
Information collected, stored, used and/or processed by the Company, as described in this Policy, is collected, stored, used and/or processed in compliance with the Company’s obligations under the Personal Data Protection Act 2012 of Singapore (“PDPA”).
European Union (GDPR)
On May 25th, 2018 the European Union (“EU”) General Data Protection Regulation (“GDPR”) came into effect. If you are located in the EU, United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the GDPR related to your Personal Data. Zinier will be the controller of all Personal Data in compliance with the GDPR policy.
Australia (AU)
All the personal information collected, stored, used and /or processes by Zinier is in compliance with the Australian Privacy Act 1988 (Commonwealth) and the Australia Privacy Principles.
United Mexican States
On July 6, 2010, the Federal Law on Protection of Personal Data Held by Individuals (LFPDPPP) entered into force. If you are in the United Mexican States, you may have additional rights under the LGPDPPP related to your Personal Data. Zinier will be the controller of all Personal Data in accordance with the policy (LFPDPPP).
13. Changes to our privacy statement
Our Company may amend this Privacy Statement at any time by posting a new version. It is your responsibility to review this Privacy Statement periodically as your continued use of this website represents your agreement with the then-current Privacy Statement.
